Privacy Policy

1. Who we are

This website (motionsmarketing.ca) is operated by Kristofer (Kris) Curman, a licensed REALTOR® with Oakwyn Realty Northwest in British Columbia (“Kris”, “we”, “us”). The site was designed and built by Motions Marketing, Kris’s own marketing studio.

We handle personal information in line with British Columbia’s Personal Information Protection Act (PIPA) and send commercial email in line with Canada’s Anti-Spam Legislation (CASL). Kris is responsible for personal information collected through this site and acts as its privacy contact.

2. What we collect

Information you give us. When you send a form — contact, showing request, buyer search, home valuation, a saved map search or a newsletter sign-up — we collect what you enter: usually your name, email, phone number and message, plus the listing or page you were on, any preferred showing times, and whether you ticked the email-updates box.

Your saved searches. If you save a map search, we store the search itself (the area, price and other filters in the page address) with your contact details so we can follow up.

Technical information. Like most websites, our hosting provider records standard server logs — IP address, browser type, pages requested and the time — to deliver the site and keep it secure.

What we don’t collect. We don’t ask for your social insurance number, banking details or ID through this website, and we don’t buy personal information from data brokers. Identity checks required by FINTRAC happen later, in person or through your brokerage paperwork — never through a web form here.

3. How we use it

To reply to your enquiry, arrange showings and provide the real estate services you ask for.
To send you listings, market updates or saved-search alerts — only if you opted in (see section 4).
To keep records Kris is required to keep as a licensee, and to meet legal and regulatory obligations.
To run, secure and improve the website — for example, spotting spam and abuse.

We use your information only for the purpose you gave it for, or a closely related one you would reasonably expect. We never sell it or rent it to anyone.

4. Email updates and consent

You’ll receive market updates, listing emails or search alerts only if you tick the opt-in box on this website (express consent under CASL), or if you already know Kris personally or have a recent business relationship with him, as CASL allows. We record when and how you were added to the list. Replies to a question you sent us are not marketing and don’t need the box.

Every marketing email includes a one-click unsubscribe link. You can also unsubscribe at motionsmarketing.ca/unsubscribe or by emailing kac@motionsmarketing.ca. We act on unsubscribe requests right away and within the 10 business days CASL allows.

Oakwyn Realty Northwest — Kris’s brokerage, where needed for supervision, record-keeping or regulatory requirements.
Service providers that run this site — Amazon Web Services (hosting, database and email delivery) and Google Workspace (Kris’s business email, where copies of enquiries arrive). They process information on our behalf and may not use it for their own purposes.
People you ask to be connected with — for example a mortgage broker, lawyer, notary or inspector — only with your permission.
Other parties in your transaction — such as the other side’s REALTOR® or a lawyer — only as needed once you’re working with Kris on a purchase or sale.
When the law requires it — for example a court order, or to protect someone’s safety.

6. Cookies, browser storage and analytics

No advertising cookies. This site doesn’t use advertising or cross-site tracking cookies, and doesn’t share your details with ad networks.

REALTOR.ca listing analytics. When you open an MLS® listing page, an anonymous view event (a random ID stored in your browser, the page address and the listing number) is sent to The Canadian Real Estate Association (CREA). The listing brokerage uses these counts to see where its listing is viewed; this is required by the REALTOR.ca DDF® rules. The random ID isn’t linked to your name or email.

Maps. The map search is provided by Google Maps. When you use it, Google receives technical information such as your IP address, under the Google Privacy Policy.

Site analytics. We use Google Analytics to understand which pages are useful (pages viewed, device type, approximate location). You can opt out with Google’s browser add-on.

The only cookie this site sets is a sign-in cookie for Kris’s private admin area. You can clear browser storage at any time in your browser settings.

7. Where your information is stored

Form submissions are stored in a private, access-controlled database in Canada (Amazon Web Services, Canada Central region), and emails from this site are sent through Amazon Simple Email Service in Canada. Copies of enquiries are delivered to Kris’s business inbox on Google Workspace, and Google Maps and CREA analytics are run by those providers — so some information may be processed outside Canada, including in the United States, where it may be accessible to authorities under local law.

8. How long we keep it

We keep enquiries only as long as we need them: generally up to 24 months after our last contact with you, then we delete them. If you become a client, transaction records are kept for as long as real estate and tax rules require. You can ask us to delete your information sooner (see section 10) unless we’re legally required to keep it.

9. Security

We use reasonable safeguards for the sensitivity of the information: the whole site runs over HTTPS, the database is encrypted at rest and closed to the public, and only Kris can sign in to the admin area. No system is perfectly secure, so please don’t send sensitive documents through a web form. If a breach puts you at real risk of significant harm, we’ll tell you and take the steps the law requires.

10. Your choices and rights

Access and correction — ask what we hold about you, and have it corrected.
Withdraw consent — unsubscribe from emails or ask us to stop contacting you, at any time.
Deletion — ask us to delete your information, subject to records we must keep by law.

11. Age

This site is meant for adults. Please don’t submit a form if you’re under 19, the age of majority in British Columbia.

12. Changes to this policy

If we change how we handle personal information, we’ll update this page and the date at the top. Significant changes that affect how we use information you’ve already given us will be explained before they apply.
